DHS Checkpoint Video Blog Day 5: The Gang's All Here

On the afternoon of February 1, 2008, I was stopped yet again at a suspicionless internal Homeland Security checkpoint on SR86 in Southern Arizona near mile post 146. The location is over 40 miles North of the border.
This was the fifth time in three weeks I've been stopped & seized at this checkpoint absent reasonable suspicion. Normally, there are only three or four agents present with two patrol vehicles parked nearby. This time the scenario were dramatically different.
Present were no less than twelve agents visible at any given time along with six Homeland Security vehicles lining the entry to the checkpoint. There was also a large United States flag flying over one of the trailers - something that hasn't been present before. Perhaps the agents were hoping the
large American flag would somehow mask their un-American activities. As I first came to a stop at the checkpoint, several agents converged on my vehicle and one can be heard pounding on the truck near time marker 01:15. About nine seconds later, another agent to the rear of my vehicle can be heard
yelling, "Hi Terry". This of course clearly indicates the agents knew who I was and, by extension, that I wasn't an illegal alien. Nonetheless, the agents continued to detain me at the checkpoint for several minutes in order to harass and intimidate. As the suspicionless seizure of my person conti
nued, a Homeland Security agent can be seen waving at me near 02:09 while several high(er) ranking agents can be seen near 02:13 standing in the background looking on with satisfaction. Whether or not they were also onscene to make sure things didn't get out of hand during the staged confrontation i
s unknown. As time progressed, another agent wearing blue 'inspection' gloves and carrying a sprint camera phone (service issue?) can be seen walking around the vehicle methodically taking photographs. His name tag indicates he is 'J. Gonzalez'. The tags appear to be attached with velcro however an
d are easily removed. As such, I give little credence to the validity of a name displayed on a tag - especially when the agents refuse to verify their identity. Near 02:39, one of the agents who initially waved at me can be seen shaking hands with another agent. Finally, near 03:22, the same agent
who yelled my name during the initial stop, yelled 'Bye Terry' after I was given permission to go on my way after Homeland Security finished having its fun. I also note the stopping agent, 'K. June' according to her name tag, refused to face me after directing me to stop. Instead, she pressed hers

decided to play hide and seek while pressing himself up against the passenger side of the cab between the front and rear doors. Approximately thirty minutes after I passed through the checkpoint, only four or five agents remained on-scene to conduct operations. This means the rest of the 'gang wit
h guns' left the scene shortly after the staged show of force ended. While watching the video, consider the lack of professionalism displayed by these Border Patrol agents at every level. These are the same agents who have been empowered with an extraordinary level of unfettered field discretion t
o stop, seize and detain individuals based upon no reasonable suspicion whatsoever. Also ask yourself how much illegal traffic crossed the border forty miles to the South of this checkpoint while twelve Homeland Security agents played domination games along a public highway that never intersects the
border at any point. The 4th amendment was specifically created to protect us against this type of arbitrary enforcement activity by over-reaching federal agencies. It would seem however that the 'writ of assistance' is alive and well in modern day America and everyone is now considered a suspect.
Far from increasing the security of the country, these checkpoints serve as little more than obedience training for the burgeoning American police state.

(a) To require that such stops always be based on reasonable suspicion would be impractical because the flow of traffic tends to be too heavy to allow the particularized study of a given car necessary to identify it as a possible carrier of illegal aliens. Such a requirement also would largely eliminate any deterrent to the conduct of well disguised smuggling operations, even though smugglers are known to use these highways regularly. Pp. 428 U. The Border Patrol's routine stopping of a vehicle at a permanent checkpoint located on a major highway away from the Mexican border for brief questioning of the vehicle's occupants is consistent with the Fourth Amendment, and the stops and questioning may be made at reasonably located checkpoints in the absence of any individualized suspicion that the particular vehicle contains illegal aliens. Now, would like to retract your statements that Martinez-Fuerte does anything other than allow checkpoints and establishes the fact that security for the whole overrides individual movement, if even for the briefest of times? You should read further. The sole purpose of secondary in Martinez-Fuerte was to make the same immigration query normally done at primary when traffic is light. In my checkpoint videos, the traffic is light so the immigration query is being made at primary. As such, any referral to secondary represents as extended detention that can only be made based upon probable cause or consent. The case (United States v. Martinez-Fuerte) involves permanent immigration checkpoints setup along nexus points for border traffic within 100 miles of an international border. The court ruling was limited to exactly those circumstances. Judge Powell went so far as to state the ruling did not apply to any other type of Border Patrol traffic stopping operation - including temporary checkpoints such as the one depicted in my videos.

Once again, you ignore the limited authority granted to the Border Patrol during such checkpoint stops: "...Our holding today, approving routine stops for brief questioning is confined to permanent checkpoints. We understand, of course, that neither longstanding congressional authorization nor widely prevailing practice justifies a constitutional violation". Thanks for making my point again irishdennyg. SCOTUS limited the scope of their ruling to permanent checkpoints, not temporary ones: "...Our holding today, approving routine stops for brief questioning is confined to permanent checkpoints. We understand, of course, that neither longstanding congressional authorization nor widely prevailing practice justifies a constitutional violation". Additionally, all checkpoint stops are subject to post-court review based upon reasonableness criteria.

irishdennyg, you're the one who stated SCOTUS has allowed temporary checkpoints to be setup anywhere inside the country for any reason when that's clearly not the case. Martinez-Fuerte was limited to permanent immigration checkpoints within 100 miles of a border while the court decided in Edmond that drug checkpoints were illegal all together. Additionally, agents cannot legally compel anyone to answer questions at a checkpoint even if the courts have ruled the checkpoint is lawful.

Wow, do you ever have it backwards. The Constitution is a rule book that applies to the government, not the people. It specifically limits what lawful powers governments can wield against the people. It's also not a suggestion. Rather, it's the Supreme Law of the Land & government officials ignore it at their own risk. Finally, our country was made great from the liberty exercised by the people, not 'laws' designed by government to control the people.

Thanks for your concern bmramire but I already have a life. These armed federal agents were interfering with it absent any suspicion. Hence the video. How exactly are they keeping me safe at night by harassing me during the day? It's not like their actually patrolling the border or anything. Rather, they're helping to keep the border purposefully porous by setting up internal checkpoints 40 miles inside the country.

many of you naysayers don't realize that this is only the beginning. What if the Supreme Court ruled that police can enter our homes without warrant if they are looking for someone? What if they could arrest you without cause if they don't like the way you cut your hair.? What if the Supreme Court ruled that your thoughts could be monitored with lasers and they put cameras in everyones homes?I'm sure most of you would throw away your rights without blinking. Checkpoints are only the first step.
