Seriously, just hit him with regular .308 if you want to snippy snap someone.
However, they wanted him alive enough to stand trial and therefore didn't kill him, since it wasn't necessary to do so. Although, I have no reason to believe they weren't ready to shoot him to pieces if that would be necessary.
